Introduction and Acceptance
These Terms of Service ("Terms") govern your use of via.email, operated by Point One Lab.
By using via.email — including sending emails to any @via.email address — you agree to these Terms. If you do not agree, please do not use the service.
Description of Service
via.email is an email-based AI agent platform. You interact with AI agents by sending and receiving emails. The service includes:
- Built-in agents — Pre-configured AI agents available to all users
- Custom agents — AI agents you create with your own instructions (available on paid plans)
- System commands — Email addresses for account management, billing, and agent operations
- AI support — An AI-powered support agent for product questions
The service is designed to work with any email client, on any device, without requiring additional software.
Account Registration
- You register by emailing join@via.email and completing email verification
- One account per email address
- You must provide your real name and a valid, non-disposable email address
- You are responsible for all activity associated with your email address
- Accounts cannot be transferred to a different email address
Email Access Responsibility
via.email lives entirely inside your email client. You are responsible for maintaining access to the email account associated with your via.email account.
- If you lose access to your email account, you will lose access to via.email and all associated agents, credits, and data
- We cannot recover, transfer, or migrate your via.email account to a different email address
- You are solely responsible for any consequences resulting from the loss of access to your email account, including but not limited to loss of credits, agents, and conversation history
- We strongly recommend that you maintain secure access to your email account, including enabling two-factor authentication where available
Plans, Credits, and Billing
- New accounts start on the Free plan with a limited number of monthly credits
- Paid plans offer additional credits, features, and capabilities. See via.email/pricing for current plans
- Credits are consumed per task based on complexity. Credit costs may vary by task type
- On paid plans, unused credits may roll over to the next billing cycle, subject to accumulation limits
- We reserve the right to modify plan features, credit allocations, pricing, and the number of credits included in each plan at any time. Material changes will be communicated in advance
- Bonus credits received through referral programs, promotional codes, or other campaigns are subject to the same credit rollover and accumulation cap rules as regular monthly credits. Bonus credits are not transferable, not redeemable for cash, and may expire according to your plan's accumulation limits
- Billing is processed through a secure, PCI DSS-compliant third-party payment processor
- You can manage your subscription by emailing subscribe@via.email
- Cancellation takes effect at the end of the current billing cycle. You will not lose access mid-cycle
- Refunds are not routinely offered. We will issue refunds in cases where the service was unusable due to errors on our part
Use of AI
via.email uses state-of-the-art AI providers such as OpenAI and Anthropic to process your requests. Important things to know:
- We select AI models and providers that do not use your data to train their systems
- We reserve the right to change the AI models and providers used by the service at any time to improve quality, performance, or cost-effectiveness
- AI outputs are not guaranteed to be accurate, complete, or suitable for any specific purpose. You should verify critical outputs independently
- AI-generated content does not constitute professional advice (legal, financial, medical, or otherwise)
Acceptable Use
You agree not to:
- Use the service for any illegal activity
- Send harmful, abusive, threatening, or misleading content to agents
- Attempt to bypass usage limits, rate limits, or other restrictions
- Use disposable or fraudulent email addresses
- Attempt to access another user's agents, data, or account
- Reverse-engineer the service, its AI models, or its infrastructure
- Use the service to generate spam, phishing, or mass unsolicited communications
- Impersonate another person or entity through the service
We reserve the right to suspend or terminate accounts that violate these terms.
Custom Agents
- Custom agents are private by default — only you can access them
- You are responsible for the instructions you provide to custom agents
- We reserve the right to review agent instructions for compliance with these Terms
- Agent email addresses are generated automatically based on the name you provide and cannot be manually customized
- Certain email addresses are reserved for system use. See via.email/rea
Intellectual Property
- via.email and its branding, design, and technology are owned by Point One Lab
- Your content — You retain ownership of all content you send to agents (email text, attachments, instructions)
- AI outputs — AI-generated responses are provided for your use. Point One Lab does not claim ownership of AI outputs generated in response to your requests
- Agent instructions — Custom agent instructions you create are your intellectual property
Privacy and Data Handling
Your privacy matters to us. Key points:
- Email content (subject, body, attachments) is automatically deleted from our servers within 24 hours of processing
- AI providers we work with do not train on your data
- We do not sell your personal information

Communications
By using via.email, you agree to receive:
- Transactional emails — Verification, usage reports, system notifications, billing confirmations
- Marketing emails — Occasional product updates and feature announcements. You can opt out at any time by replying to any such email or contacting support@team.via.email
Service Availability
- We aim for high availability but do not guarantee uninterrupted, error-free service
- We may perform maintenance or updates that temporarily affect availability
- We will make reasonable efforts to notify users of planned downtime
- The service is provided on an "as available" basis
Limitation of Liability
- The service is provided "as is" and "as available" without warranties of any kind, either express or implied
- Point One Lab is not liable for the accuracy, completeness, or suitability of AI-generated content
- Point One Lab is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities
- Our total liability for any claim is limited to the amount you paid to us in the 12 months preceding the claim
- You agree to use the service at your own risk and verify critical outputs independently
Force Majeure
Point One Lab shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, acts of God, or severe weather events
- War, terrorism, civil unrest, or government actions
- Cyberattacks, DDoS attacks, or other malicious third-party interference
- Failures or outages of third-party service providers (including AI providers, email infrastructure, payment processors, or cloud hosting)
- Internet or telecommunications failures
- Epidemics, pandemics, or public health emergencies
- Power outages or infrastructure failures
In the event of a force majeure, we will make reasonable efforts to resume the service as soon as practicable. No refunds or credits will be issued for service disruptions caused by force majeure events.
Our Reserved Rights
We reserve the right to, at our sole discretion and without prior notice except where required:
- Suspend or terminate accounts that violate these Terms
- Delete Free plan accounts after 12 months of continuous inactivity
- Modify, add, or remove features of the service
- Change the AI models, providers, or infrastructure used to operate the service
- Adjust credit allocations, accumulation caps, and plan pricing
- Limit or restrict access to certain features based on usage patterns or abuse prevention
- Remove or modify agent instructions that violate acceptable use policies
- Send system notifications, service updates, and security alerts
Material changes to plans or pricing will be communicated in advance.
Account Suspension and Termination
- We may suspend accounts immediately if we reasonably believe a violation of these Terms has occurred
- We may permanently terminate accounts for repeated or severe violations
- We reserve the right to delete Free plan accounts after 12 months of continuous inactivity
- You can delete your account at any time by emailing support@team.via.email. Account deletion is permanent and cannot be undone
- Upon termination, your credits, agents, and associated data will be permanently deleted
Age Requirement
You must be at least 13 years old to use via.email. By using the service, you represent that you meet this age requirement.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email. Your continued use of via.email after changes take effect constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws applicable to Point One Lab's jurisdiction of operation, without regard to conflict of law principles.
