Dear Sir/Madam,
This firm represents Mercer Brand Holdings LLC, the exclusive owner of U.S. Trademark Registration No. 6,847,231 for the mark CLEARPATH in connection with business consulting services (Class 35).
It has come to our attention that you are using the name ClearPath in connection with your consulting business, including on your website and marketing materials. This use constitutes trademark infringement under 15 U.S.C. 1114 and unfair competition under 15 U.S.C. 1125(a), causing consumer confusion and diluting the distinctive value of our client's mark.
We demand that you immediately:
1. Cease all use of the name ClearPath and any confusingly similar variations
2. Remove all references from your website, social media, and printed materials
3. Provide written confirmation of compliance within 14 days of this letter
Failure to comply will result in our client pursuing all available legal remedies, including injunctive relief and statutory damages up to $2,000,000 per mark per type of goods under the Lanham Act.
